Labour Rights

  1. The laborer should be aware of all his rights set forth in the employment contract sighed with the employer as the contract is binding to both parties. No excuse for anyone ignoring the contract terms and conditions once signed by him.

  2. The permanent Constitution of the United Arab Emirates states in Article (40) that foreigners in the UAE enjoy rights and freedom as prescribed by the applicable International Constitutions, Treaties or Conventions including the right to practice religious rites, freedom of belief and the right not to hurt dignity.

  3. The laborers shall have the right not to disclose his ID to any persons without knowing his capacity.

  4. The laborer shall have the right not to be subject to any act humiliating, hurting his dignity or causing him physical injury as the law grants him the right to complain and report (as the case may be) against any person committing such crime.

  5. The laborers shall have the right, when giving his declaration before competent authorities to speak in his own language assisted by an interpreter.

  6. The laborer shall have the right not to sign on any of his declarations before competent security or judicial authorities unless fully read or perused by him.

  7. The laborer shall have the right to know the accusation attributed to him prior defending himself and the right to keep silent without reply.

  8. The laborer shall have the right to seek an advocate to defend him pursuant to the estimation of investigation authorities.

Labour Duties

  1. The laborers should know that the UAE when warmly and generously welcomes him with Islamic manners, this does not mean he is permitted to violate or humiliate its traditions, conventions or heritage. The laborer should be fully aware of this and show his respect.

  2. On the laborer's first step on the land of the UAE, his is supposed to know he is subject to all applicable rules and regulations (Residence rules, traffic, etc.)

  3. The laborers should not deal with any person out of the official departments to clear his documents whatever efficient he pretends to be. Dealing with non-official personnel shall cause him to be questioned.

  4. Whereas the laborer has all rights prescribed by laws and legislations in the UAE, he is therefore expected to equally comply with respect of others' rights. He should neither humiliate nor hurt their dignity, nor offend their religion (offending Islam or swearing any heavenly religious is deemed a crime resulting in detention or fine).

  5. Claim for rights shall not grant the right to labourer to attack properties or strike or sit-in or demonstrate causing danger to establishments or personnel. The country has provided all legal and lawful means to claim his rights, therefore on committing such violations, he shall be strictly stopped.

  6. The workplace is the laborer’s source of income, therefore maintaining such place is a legal and moral duty. He should not cause damage to his workplace whether intentionally or by way of negligence. This leads the laborer to be legally questioned.

  7. The laborers should avoid violation of the UAE laws and in no circumstances abstain from accepting to work in order to hide himself from the Police or other authorities. This may result in exploiting the laborer by others.

  8. The laborers should comply with all internal rules and regulations at his workplace like Industrial Security relating to establishment protection or workers therein.

  9. It is strictly prohibited to have Alcohol drinks or drugs or any other unknown items offered by others that can keep laborer absent minded. This results in legal penalty to the laborer.

  10. The laborers should honestly cooperate with all competent security and judicial authorities in giving all information required from him. This is deemed a moral and legal duty in achieving security for all.

  11. The laborers should respond to the call of justice when required to be a witness or he will be subject to penalty due to abstaining from testimony. (jail for one year and AED 5000/- fine).

  12. The laborer should report any crime he has realized by any of his senses or he will be subject to penalty.

  13. The laborer should abstain from propagation and circulation of rumors or he will be subject to legal penalty of maximum three year jail. In the event of hearing any rumor, he can make sure if it is true by contacting G.H.O. of Police in the UAE.

  14. The laborer should not engage in any other jobs outside his work place. Working with others than that of his sponsor will be considered illegal employment. Those who utilize workforce of such illegal works will be levied penalty up to AED 50000/-
